AN ACT TO ESTABLISH MT. MALINDANG NATURAL PARK,LOCATED IN THE PROVINCE OF MISAMIS OCCIDENTAL ASA PROTECTED AREA AND ITS PERIPHERAL AREAS ASBUFFER ZONE, PROVIDING FOR ITS MANAGEMENTPURSUANT TO REPUBLIC ACT NO. 7586 (NIPAS ACT OF1992) AND FOR OTHER PURPOSES
AN ACT DECLARING MT. HAMIGUITAN RANGE AND ITSVICINITIES AS PROTECTED AREA UNDER THE CATEGORYOF WILDLIFE SANCTUARY AND ITS PERIPHERAL AREASAS BUFFER ZONE AND APPROPRIATING FUNDSTHEREFORE
An act to prohibit the cutting, destroyingor injuring of planted or growing trees,flowering plants and shrubs or plantsof scenic value along public roads,in plazas, parks, school premises orin any other public ground.
Upon the recommendation of the Secretary of Environmentand Natural Resources and by virtue of the powers vested inme by law, I, GLORIA MACAPAGAL – ARROYO, Presidentof the Republic of the Philippines, do hereby amendProclamation No. 42 dated July 5, 1954 and the series ofpertinent subsequent proclamations, transferring theadministrative jurisdiction, control, management, developmentand disposition of portions of R.P. Lot Nos. 3-B-4-B-1-B-4-Dand 3-B-3-A-1-B-3-B-2, which form part of the QuezonMemorial Park Reservation at North Triangle Subdivision andEast Triangle subdivision, respectively, from the Parks andWildlife Bureau (formerly Parks and Wildlife Office),Department of Environment and Natural Resources (DENR)to the National Housing Authority (NHA), which portions are,subject to final survey, more or less generally identified asfollows:
Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue ofthe powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of thePhilippines, do hereby declare a parcel of land of public domain containing an area ofapproximately TWO HUNDRED SEVENTY EIGHT (278) HECTARES situated in BarangaysLubigan and Moriones, San Jose, Tarlac, for eco-tourism park and campsite purposes, under themanagement and administration of the Provincial Government of Tarlac, subject to the provisionsof Executive Order No. 111 dated June 17, 1999, existing laws, rules and regulations of theDepartment of Environment and Natural Resources (DENR) and those which may hereinafter beenacted, subject to vested rights, if any there be, which parcel of land is particularly described asfollows:
Upon recommendation of the Secretary of Environment and Natural Resources and pursuant tothe power vested in me by the law, I, GLORIA MACAPAGAL-ARROYO, President of theRepublic of the Philippines, do hereby declare a certain parcel of land of the public domainlocated at Barangay Binlod, Municipality of Argao, Province of Cebu, for Eco-Tourism Site,purposes under the Administration of the Municipality of Argao, Province of Cebu, subject toprivate rights, if any there be, which parcel of land is more particularly described as follows:
Upon recommendation of the Secretary of Department of Environment and Natural Resources(DENR) and pursuant to the powers vested upon me by law and by the provisions of Republic ActNo. 7586, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, dohereby set aside and declare a parcel of land situated in the Municipalities of Diffun, Cabarroguis,Aglipay, Maddela and Nagtipunan, Province of Quirino as protected area under the category ofProtected Landscape, subject to private rights, and without prejudice to the rights of theindigenous, Peoples as provided for in R.A. No. 8371, DENR Administrative Order 93-02 andother related rules and regulations, if any there be, as described in the DENR NIPAS Map No. R-2-6.
Pursuant to the provisions of DAO 98-24 otherwise known as the "Manual of - Approvals", and in order to avoid delays and inconvenience to DENR clientele, thefollowing are hereby authorized to issuelapprove Wildlife Local Transport Permit(WLTP):
Pursuant to Republic Act No. 7586 or the NlPAS Act and in order to provide amore appropriate criteria that will suit the present biophysical and socio-economicconditions of protected areas in the country, the criteria and guidelines for thecategorization of protected areas under NlPAS as provided under Annex A of DMC35 Series of 1993 is hereby amended in accordance with the attached matrix.
Pursuant to the provisions of Executive Order No. 192 and in line with our commitmentto the UN Convention on Biological Diversity, the Llhl Framework Convention on ClimateChange, the UN Convention to Combat Desertification and the United Nations Forum onForests, and to the principle of Sustainable Forest Management, the following guidelinesfor the integration of rainforestation farming strategy in the development of open areasand denuded forests to promote biodiversity conservation and sustainable developmentin protected areas and other appropriate forest lands are hereby promulgated:
In the best interest of the service and in order to give ample time to zoo owners, hobbyist, pet owners and private wildlife collectors to register their wildife stock and facilities with the DENR, the filing of application for the registration of threatened, non-threatened and exotic faunal species in the possession of private person(s) and entities, as provided for under DENR Adm. Order No. 2004-58 dated August 31, 2004 is further extended for another sixty (60) days reckoned from the effectivity of this Order.
In the interest of the service and in order to give zoo owners, hobbyist, pet owners and private wildlife collectors the opportunity to have their wildlife stock and facilities registered with the DENR, the corresponding fees for the registration of threatened, non-threatend and exotic faunal species, as provided for under Section 3 of the DAO 2004-62, is further waived and amended as follows:
Pursuant to Section 9 of DAO 2004-55 and DAO 2004-58 both dated August 31, 2004, the following fees and guidelines pertaining to the registration of threatened, non-threatened and exotic faunal species under the jurisdiction of the DENR, are hereby promulgated for the information and guidance of all concerned.
